Subject: Claims against the Apes Hill Club Homeowners Association (“HOA”), Apes Hill (Barbados) (“Controlling Member”), the current Directors of the HOA appointed by Controlling Member, and Garden Wall Villa Association

Dear Fellow Members of the HOA:

I am pleased to report that at a hearing held on 2 April 2025, Justice Bryan Weekes of the High Court delivered his decision on the Claimants’ applications for specific disclosure and a trial of preliminary issues.

The application for specific disclosure was granted in part and is contained in a draft order that is now being finalized. Once the final order is received by me, it will be sent to you. The Claimants’ application requesting a trial of preliminary issues was denied. The Judge was of the view that the matter was now ready for a full trial and did not require the issues to be bifurcated. The Judge scheduled five expedited trial dates from 13 October 2025 to 17 October 2025.
