Dear Fellow Members: 

I enclose a report from counsel for the Claimants for your information:

On March 3, 2026, the trial was adjourned to March 4, 2026 for the consideration of the Defendants’ application for an adjournment, which had been filed on February 20, 2026. During the proceedings, Attorneys-at-Law for the Claimants placed on record that several preliminary issues remained outstanding in relation to discovery and would need to be addressed on March 4, 2026. Counsel for the Claimants further indicated that the Claimants intended to oppose the Defendants’ application for an adjournment.

On March 4, 2026, the Court heard the Defendants’ application for an adjournment and refused the application. During the hearing, the Court made several orders in relation to the application for an adjournment and the preliminary issues raised in relation to disclosure. These orders are reflected in a draft order prepared by the Attorneys-at-Law for the Claimants for the Court’s approval and perfection. The draft order has not yet been perfected and remains subject to the Court’s review, approval, and any necessary correction. However, the substantive paragraphs of the draft order are reproduced below for your convenience:

  1. The First Defendant’s application for adjournment of the trial dates set for March 2, 2026, to March 6, 2026, is denied.
  2. The Second Defendant is at liberty to file and serve a Supplemental Witness Statement on or before March 23, 2026.
  3. The Second Defendant’s application for adjournment of the trial dates set for March 2, 2026, to March 6, 2026, is denied on the condition that the Second Defendant’s evidence and any supplemental Witness Statement is admitted into evidence pursuant to section 51 of the Evidence Act Chapter 121 of the Laws of Barbados.
  4. Leave to appeal the Court’s decision to refuse the First and Second Defendants’ application for adjournment of the trial dates set for March 2, 2026, to March 6, 2026, is denied.
  5. The Claimants shall file and serve an amended application for specific disclosure on or before March 04, 2026.
  6. The Defendants are at liberty to file and serve an affidavit in response to the Claimants’ amended application for specific disclosure, only if there are significant refusals to disclose the documents requested in the Claimants’ amended application.
  7. The matter is adjourned until March 5, 2026 at 2:00 p.m., for the hearing of the Claimants’ amended application for specific disclosure.
  8. Trial is set for March 6, 23, 24, 25 & 26, 2026.

On March 4, 2026, in compliance with the Order of the Court, the Claimants filed their amended application for specific disclosure. A copy of the application is attached for your records. By email dated March 5, 2026, the Court adjourned the hearing set for March 5, 2026 at 2:00 pm until March 6, 2026.

On March 6, 2026, Attorneys-at-Law for the First to Fourth Defendants made an oral application which the Court requested be reduced to writing and filed and served on all parties on or before March 23, 2026. The matter was thereafter adjourned to March 23, 2026.
